This Privacy Policy explains how TempoSense (“TempoSense”, “we”, “us”, “our”) collects, uses, and protects information about users of the TempoSense mobile application and related services (collectively, the “Service”).

By using the Service, you agree that we may process your information in accordance with this Privacy Policy and applicable law.
1. Information We Collect
We collect the following categories of information when you use TempoSense:
1.1 Information You Provide Directly
Uploaded audio files
Audio files you upload are temporarily processed on our servers and deleted shortly after processing is complete. The processed version is stored only locally on your device. The app may delete these local files after a certain period depending on your plan (for example, after three (3) weeks for Free users). We do not retain full copies of your audio files on our servers after processing.Support communications
If you contact us by email or other channels (for support, feedback, etc.), we will collect the information you provide, such as your name (if given), email address and the content of your message.
We do not operate a separate account system or login. We do not ask you to create a username/password within TempoSense.
1.2 Information Collected Automatically
When you use the Service, we may automatically collect:
Apple Watch motion data
Motion data from your Apple Watch (e.g. accelerometer and gyroscope readings) while you are running a practice session. This is used to analyze your drumming (timing, stroke patterns, etc.).Performance and practice metrics
For example:Timing deviation / accuracy
Consistency metrics
Tempo, session duration
TScore or similar scores and summaries
Session and usage data
Such as:Date and time of sessions
Selected tempo, song identifiers, and practice mode
Basic app interaction events (e.g. when you start/stop a session, open certain screens).
Device and technical data
Such as:Device model
Operating system and version
App version
Language and region settings
Crash logs and diagnostic information
We may use third-party tools or libraries (e.g. for analytics, crash reporting) to help us collect this technical data. These providers are described in Section 6.
1.3 Information from Apple (Subscriptions & Purchases)
We do not receive your full payment information. Purchases and subscriptions are processed by Apple’s App Store.
We may receive limited information from Apple necessary to operate the Service, such as:
Confirmation that a subscription has been purchased, renewed, cancelled or expired.
Non-identifying information related to your Apple ID’s subscription status (e.g. subscription type, renewal period).
2. How We Use Your Information
We use the information we collect for the following purposes:
To provide and operate the Service
Process Apple Watch motion data and audio uploads to generate feedback and metrics.
Display live and historical performance information (e.g. scores, progress graphs).
Enforce plan limits (e.g. number of uploads per calendar month, song expiry behaviour).
To improve and develop the Service
Analyse anonymous or aggregated usage data to understand how the app is used.
Improve our algorithms, user experience, and features.
Fix bugs and monitor performance.
To manage subscriptions and access
Determine whether you are using the Free Plan or Pro Plan.
Apply the correct upload limits and song availability rules.
Check subscription status (active, expired, cancelled).
To communicate with you
Respond to support requests and feedback.
Send you important service-related notices (e.g. changes to this Policy or Terms).
To ensure security and prevent misuse
Detect and prevent fraudulent, abusive or unlawful behaviour.
Protect the integrity and availability of the Service.
Where required by law, we will obtain your consent for certain uses (for example, for certain types of analytics or marketing communications).
3. Legal Bases for Processing (EU/EEA Users)
If you are in the European Economic Area (EEA) or the UK, we process your personal data on the following legal bases under the GDPR:
Performance of a contract (Art. 6(1)(b) GDPR)
To provide the Service and its core features (drumming feedback, uploads, subscription benefits), including:Processing motion data and audio files.
Storing and showing your practice metrics and progress.
Applying plan limits and access.

Our legitimate interests include:Improving and developing the Service.
Preventing misuse, fraud, or security incidents.
Producing anonymous or aggregated statistics about app usage.
When we rely on legitimate interests, we balance our interests against your rights and expectations.

For certain non-essential processing (for example, some forms of analytics or marketing communications), where required by law, we will rely on your consent and allow you to withdraw it at any time.
4. Cookies and Similar Technologies
TempoSense as a mobile app does not use traditional browser cookies. However, we and our service providers may use similar technologies within the app (such as device identifiers or SDKs) to:
Perform analytics and understand app usage.
Diagnose crashes and technical issues.
Improve the user experience.
If we operate a website for marketing or documentation, that site may use cookies. In that case, additional information will be provided on the website (e.g. a cookie banner or separate cookie notice).
5. How We Share Information
We do not sell your personal data.
We may share information in the following limited circumstances:
5.1 Service Providers
We may share information with trusted third-party service providers who help us operate the Service, such as:
Cloud hosting and storage providers (for storing audio uploads and derived data).
Analytics providers (to understand how the app is used).
Crash reporting and diagnostics providers (to detect and fix technical issues).
These providers process data on our behalf and are contractually obligated to protect it and use it only for the purposes we specify.
5.2 Apple (App Store and System Services)
As subscriptions and purchases are handled by Apple, Apple will process your payment information and may share limited subscription-related data with us (as described earlier). Apple processes this data under its own terms and privacy policies.
5.3 Legal and Safety
We may disclose information if we believe in good faith that it is reasonably necessary to:
Comply with applicable law, regulation or legal process.
Respond to lawful requests from public authorities.
Protect the rights, property, or safety of TempoSense, our users, or others.
5.4 Business Transfers
If we are involved in a merger, acquisition, sale of assets, or similar corporate transaction, your information may be transferred as part of that transaction, subject to this Privacy Policy and any additional safeguards required by law.
5.5 Aggregated or Anonymised Data
We may use and share aggregated or anonymised information that does not identify you personally for purposes such as statistics, research, and improving or promoting the Service.
6. International Data Transfers
Our servers or some of our service providers may be located outside your country, including outside the European Economic Area (EEA) or the United Kingdom.
Where personal data is transferred to a country that does not provide an adequate level of data protection, we will implement appropriate safeguards as required by law, such as:
Standard Contractual Clauses approved by the European Commission, or
Other equivalent legal mechanisms.

7. Data Retention
We retain personal data only for as long as necessary for the purposes described in this Privacy Policy, or as required by law.
In particular:
Uploaded audio files (songs)
Free Plan: songs are typically available for up to two (2) weeks from upload, after which they expire and may be deleted or removed from active systems in accordance with our technical and operational practices.
Pro Plan: songs uploaded while your subscription is active remain available for as long as your subscription remains active, unless removed by you or as otherwise stated in our Terms. After your subscription ends, such songs may become unavailable and may be deleted after a certain period.
Practice metrics and usage data
We may retain practice history, scores and related metrics for as long as you continue to use the Service and for a reasonable period afterwards, or as required by law. Some data may be anonymised and retained longer for statistical and service improvement purposes.Support communications
Emails and support messages may be retained for as long as necessary to handle your request and for a reasonable period afterwards, in case of follow-up, disputes or legal obligations.
We may retain certain information longer if necessary to comply with legal obligations, resolve disputes, or enforce our agreements.
8. Security
We take reasonable technical and organisational measures to protect your information against unauthorised access, loss, misuse, or alteration. These measures may include:
Encryption in transit between your device and our servers.
Access controls and limited access to personal data within our systems.
Use of reputable hosting and infrastructure providers.
However, no system can be guaranteed to be completely secure. You use the Service at your own risk and are responsible for maintaining the security of your device and Apple ID.
9. Your Rights (EEA/UK Users)
If you are in the EEA or the UK, you have certain rights regarding your personal data under the GDPR, including:
Right of access – to obtain confirmation of whether we process your personal data and, if so, receive a copy.
Right to rectification – to request correction of inaccurate or incomplete data.
Right to erasure – to request deletion of your personal data in certain circumstances.
Right to restriction – to request restriction of processing in certain circumstances.
Right to data portability – to receive your personal data in a structured, commonly used and machine-readable format and to transmit it to another controller where technically feasible.
Right to object – to object to processing based on our legitimate interests or for direct marketing.
Right to withdraw consent – where processing is based on consent, you can withdraw it at any time without affecting the lawfulness of processing before withdrawal.

You also have the right to lodge a complaint with your local data protection authority. In the Netherlands, this is the Autoriteit Persoonsgegevens.
10. Children’s Privacy
TempoSense is not directed at children under the age of 13 and we do not knowingly collect personal data from children under 13. If you are under 13, please do not use the Service.
If we learn that we have collected personal data from a child under 13 without appropriate consent, we will take reasonable steps to delete it. If you believe that a child has provided us with personal data, please contact us at temposense.io@gmail.com.
If you are in the EEA/UK and under the age at which you can legally consent to data processing in your country, you should only use the Service with the permission of your parent or legal guardian.
11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify you by updating the “Last updated” date at the top of this Policy and, where appropriate, by providing additional notice in the app (for example, via a notification or in-app message).
Your continued use of the Service after any changes become effective will mean that you accept the updated Privacy Policy. If you do not agree to the changes, you should stop using the Service and, if applicable, cancel your subscription and delete the app.
